Capital Formation Deal Elusive as Senators Race Against Clock

San Diego-based Amit Singh, a shareholder in the firm’s M&A and Emerging Growth practice groups, was quoted in the article, “Capital Formation Deal Elusive as Senators Race Against Clock,” published by Bloomberg Law – Securities Law News on November 30. The article covered the bipartisan package of capital formation bills, also known as the Jobs Act 3.0, that passed the House in July and is trying to make its way to the Senate floor. According to the article, “the most obvious path is to add Jobs 3.0 to a government funding bill that must be completed before a Dec. 7 deadline to avoid a partial government shutdown.”

Jobs 3.0 contains over 30 individual bills, several of which are intended to help companies raise capital through venture capital funds, IPOs and individuals. Singh states that “passage of the package would bring far more clarity to the investment and small business sector” but also that “investment and small business communities won’t be devastated if Jobs 3.0 gets delayed until the next Congress.”
